Terms and conditions

These terms apply to every order you place with DeusFix. The Dutch version is the legally binding one; this English version is a translation for your convenience.

1. Definitions

  • Seller: the business named in article 2.
  • Consumer: a natural person who is not acting for purposes related to their trade, business, craft or profession.
  • Distance contract: a contract concluded through this webshop without both parties being physically present at the same time.
  • Withdrawal period: the 14-day period in which the consumer may withdraw from the distance contract.
  • Product: a used or refurbished device or part offered in the webshop. Every product is a unique unit.
  • Durable medium: any means, such as email, that lets the consumer store information addressed to them.

2. Identity of the seller

DeusFix, Wasaweg 21 48, 9723 JD Groningen, the Netherlands.

Email: shop@deusfix.com.

Chamber of Commerce (KvK) number 42170751, branch number 000066765536. VAT number NL870025624B01.

3. Applicability

These terms apply to every offer by the seller and to every distance contract between the seller and a consumer. Before the contract is concluded, the text of these terms is made available to the consumer on the website and in the order confirmation.

Where these terms conflict with mandatory consumer law, the law prevails. If a provision is void, the other provisions remain in force.

4. The offer

Every product is described as accurately as possible: its grade, known defects, specifications, included accessories and photos of the actual unit. Obvious mistakes or errors in the offer do not bind the seller.

Because every unit is unique, an offer lasts while the unit is available. A unit placed in someone's checkout is reserved for 15 minutes and is shown as reserved during that time.

5. The contract

The contract is concluded when the consumer completes the order and the payment is received. The seller confirms the order by email without delay.

If the unit turns out to be unavailable after payment (for example because it was sold through another channel at the same moment), the seller cancels the order and refunds the full amount within 14 days.

6. Right of withdrawal

The consumer may withdraw from the contract without giving a reason within 14 days. The period starts on the day after the consumer, or a third party designated by the consumer, received the product. Full details and the model withdrawal form are on the right of withdrawal page.

7. Obligations during the withdrawal period

During the withdrawal period the consumer handles the product and its packaging with care. The consumer may only unpack and use the product as far as needed to assess its nature, characteristics and functioning, as one would in a shop.

The consumer is liable for any reduction in value caused by handling the product beyond that. Factory-reset data stays the consumer's responsibility: remove accounts (such as Apple ID or Google account) and personal data before returning a device.

8. Exercising the right of withdrawal and costs

The consumer reports a withdrawal within the period through the online withdrawal form, the return request page or another unambiguous statement, for example by email.

The consumer sends the product back within 14 days after reporting the withdrawal, with all accessories delivered and, where reasonably possible, in the original condition and packaging. The return number must be on or inside the parcel.

The direct cost of returning the product is borne by the consumer, unless the product is defective or not as described; in that case the seller pays the return shipping.

9. Obligations of the seller on withdrawal

The seller refunds all payments received from the consumer, including the standard delivery cost charged for the returned product, without delay and at the latest within 14 days of the day the consumer reported the withdrawal. Extra cost for a more expensive delivery method chosen by the consumer is not refunded.

The seller may wait with the refund until the product has been received back, or until the consumer shows that it was sent back, whichever comes first. The refund uses the same payment method the consumer used, unless agreed otherwise.

10. Price and VAT

Prices include VAT where VAT applies. Many products are sold under the margin scheme for second-hand goods (article 28b of the Dutch VAT Act); for those products VAT is not shown separately on the invoice and cannot be reclaimed. The product page and invoice say which scheme applies.

Shipping costs are shown before the order is placed. Delivery by PostNL or DHL costs €6.95, and is free for orders from €100.00. Collecting the order in person is free.

11. Conformity and warranty

The seller guarantees that products conform to the contract, to the specifications in the offer, and to the reasonable requirements of soundness and usability for a used product of the stated grade.

In addition, every product carries a 12-month warranty from delivery. This warranty does not limit the consumer's statutory rights. See the warranty page for what is covered and how to claim.

12. Delivery

The seller ships orders as soon as possible, normally within two working days after payment, and at the latest within 30 days. The risk of loss or damage passes to the consumer when the product is delivered to the consumer or to a third party designated by the consumer (not the carrier).

The consumer may also collect the order at Wasaweg 21 48, 9723 JD Groningen (By appointment). The seller emails when the order is ready.

13. Payment

Payment takes place in advance through the payment provider Mollie, with iDEAL, credit card or Bancontact, or with a gift card of the seller. The seller never receives or stores card details.

14. Complaints

Complaints about the performance of the contract should be submitted to shop@deusfix.com in full and clearly described, within a reasonable time after the consumer discovered the defect. The seller replies within 14 days of receipt. If a complaint needs more time, the seller confirms receipt within 14 days and says when a full answer can be expected.

15. Disputes and applicable law

Dutch law applies to contracts between the seller and the consumer. This choice does not deprive the consumer of the protection of mandatory provisions of the law of their country of residence. Disputes are submitted to the competent court in the Netherlands, unless mandatory law gives the consumer another choice.

16. Gift cards and promotion codes

Gift cards can be used for purchases in the webshop until their expiry date, are not exchangeable for cash and are treated like cash once issued. Promotion codes apply under the conditions stated with the code and cannot be combined unless stated otherwise.
